Somebody get a lawyer, a good one without any axes to grind, to take a second look at this Victoria Toensing piece in today’s Washington Post.
Stephen, I don't know which axe I'm not supposed to grind but I've read Victoria's piece. It seems a relatively lucid explanation for why detention as an enemy combatant is both necessary and proper.
I gave it a quick scan, and it looked alright to me. I am a lawyer, with axes to grind, etc., but as a pro-war libertarian my axes tend to balance out on this issue, I think.
The only thing I would quibble with is her first sentence, where she asserts the 9/11 attacks were the first act of war. There were of course, a number of earlier such acts.
